Terms of Service

1. Definitions

• “User(s)” refers to individuals, organizations, or authorized representatives who access or use the Platform.
• “Customer(s)” refers to businesses that subscribe to our Services.
• “Company” refers to 3FTECH GROUP PRIVATE LIMITED, the owner and operator of Brijik CRM.
• “Platform” refers to the Brijik CRM cloud-based software, including the website (www.brijik.com), web application, mobile application(s), and related services, features, tools, and content provided by the Company.
• “Services” refers to the CRM features, sales automation, lead management, reporting, integrations, and any other functionality offered through the Platform.

2. Eligibility & Account Registration

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use the Platform and Services. By creating an account, you confirm that you meet this requirement and that all registration information provided is accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities under your account. The Company is not liable for any unauthorized access resulting from your failure to maintain the security of your credentials. You must notify us immediately of any suspected breach.

3. Use of Services

You agree to use the Platform only for lawful purposes and in accordance with these Terms, our Acceptable Use Policy (AUP), and applicable laws. Prohibited activities include, but are not limited to:

• Attempting to gain unauthorized access to the Platform or other accounts.
• Using the Services to transmit harmful or malicious content.
• Engaging in fraudulent, abusive, or unlawful activities.

4. Subscriptions & Payment

Certain features require a paid subscription. Fees are billed according to your selected plan and are subject to applicable taxes. Payments are processed securely by third-party payment providers. By subscribing, you authorize us to charge recurring fees until you cancel.

Refunds, where applicable, are provided under our Refund Policy. We do not guarantee refunds outside of this policy.

5. Acceptable Use

You must comply with our Acceptable Use Policy (AUP) at all times. You may not use the Platform to:

• Upload or distribute unlawful, harmful, or abusive content.
• Violate intellectual property or privacy rights of others.
• Disrupt or overload the Platform infrastructure.

Violations may result in immediate suspension or termination of your account.

6. Intellectual Property

All intellectual property rights in the Platform, including software, design, trademarks, and content, belong to the Company or its licensors. You may not copy, modify, distribute, or create derivative works without prior written consent.

You retain ownership of your CRM Data uploaded to the Platform. By using the Services, you grant the Company a limited license to process your data solely for service delivery.

7. Confidentiality & Data

Both parties agree to maintain the confidentiality of sensitive information. Data processing and protection are governed by our Privacy Policy. We implement security measures to protect your data, but you acknowledge that no system is fully secure.

8. Third-Party Services

The Platform may integrate with third-party services such as payment processors or communication tools. These services are governed by their own terms and policies. The Company is not responsible for the availability, security, or accuracy of third-party services.

9. Termination

We may suspend or terminate your access if you breach these Terms, fail to pay subscription fees, or engage in harmful activities. You may terminate your use of the Platform at any time. Provisions relating to intellectual property, confidentiality, indemnification, and limitation of liability will survive termination.

10. Disclaimers & Limitation of Liability

The Platform is provided on an “as is” basis without warranties of any kind. We disclaim liability for indirect, incidental, or consequential damages, including loss of data or profits. Our maximum liability under these Terms is limited to the subscription fees paid in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless the Company, its employees, and affiliates from any claims, damages, or expenses arising out of your use of the Platform, your violation of these Terms, or infringement of third-party rights.

12. Changes to Terms

We may revise these Terms periodically. Updated versions will be posted on the Platform with a revised “Last Updated” date. Continued use after changes indicates acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of the courts in Mumbai, India.
